1. Introduction

1.1 We welcome you to use our online payment facility (QSS Online Payment Facility) to pay your accounts with Queen Street Studio.

1.2 We endeavour to make your payment process a secure and convenient experience, and invite you to carefully read these Terms and Conditions which govern the use of this QSS Online Payment Facility.

2. Accepted Credit Cards

2.1 We currently accept the use of the following credit cards for payment of your Queen Street Studio accounts through the QSS Online Payment Facility:
• Visa
• Mastercard
• Discover

3. Information provided by you

3.1 We require you to provide us with certain information about yourself when you use the QSS Online Payment Facility to make payment of your bills. This information may include your name, email address, credit card number, invoice number and other personal particulars. We use this information to ensure that the payment process is carried out accurately and efficiently.

3.2 If you do not wish to provide us with the required information, you will not be able to make further use of the QSS Online Payment Facility and we recommend that you do a direct EFT to:

3.3 If you wish to use our QSS Online Payment Facility, you agree to ensure that any information provided by you shall be complete and accurate. You shall not at any time provide us with information which is false, inaccurate, misleading, obsolete or deceptive. If we have reasonable grounds to believe that you have not provided us with accurate information, we may choose not to proceed with the processing of your payment and the relevant invoices shall remain outstanding.

Making a Payment

1. It is your responsibility to have sufficient cleared funds available in your account to permit the debiting of the authorised amount.

2. Online payments authorised on or before 5.00pm on a business day will usually be debited from the nominated account on that business day.

3. Online payments authorised after 5.00pm on a business day, or on a day other than a business day, will usually be debited from the nominated account on the next business day. The date of receipt will be the same as the day that you authorised the online payment.

4. If you change your account and want to continue making online payments, it is your responsibility to inform us of these changes.

5. Once you have received confirmation of your booking you agree to pay Queen Street Studio according to the Terms and Conditions set out in your Venue Agreement. See also http://www.queenstreetstudio.com/terms.html. All hire fees are GST inclusive.

6. When making a payment through the QSS Online Payment Facility you will be charged a PayPal handling fee of 2.4% on the total amount.

4. Confirmation of Payment

4.1 Once a payment is made you will be issued with a receipt to your nominated email address upon it being successfully processed through Paypal. This is your record of payment.

5. Security

5.1 Your payment information is protected using a PayPal Verisign certificate, which is the data encryption technology used by many online payment systems. Generally this is determined by a lock icon displayed in your web browser and an “s” after the http in the URL (https://)

5.2 We use all reasonable endeavours to ensure the integrity of the QSS Online Payment Facility’s PayPal Security. Despite our endeavours, breaches of security and confidentiality could occur. You acknowledge that under no circumstances will Queen Street Studio be liable for any loss suffered by you as a result of any breaches in security.

6. Passwords

6.1 You are required to maintain the confidentiality and secrecy of any user access codes or passwords (Passwords) which we may issue to you, and you shall be fully responsible for all acts or omissions that are conducted by any party under or using your Passwords.

6.2 You agree to immediately inform and notify us of any unauthorised use of your Passwords.

6.3 We may at any time change your Passwords without notice if we believe it is necessary to ensure the security of our computer systems or services.

7. Defects in QSS Online Payment Facility

7.1 We shall not in any way be liable for any delay, disruption or defects in the QSS Online Payment Facility.

7.2 You acknowledge that you assume all the risks involved in using our QSS Online Payment Facility and we shall not be in any way liable for any damage, loss, expense or detriment caused (directly or indirectly) by a defect in our QSS Online Payment Facility.

8. Exclusion of Warranties and Implied Terms

8.1 Except as expressly provided to the contrary in these Terms and Conditions, all terms, conditions, warranties, undertakings, inducements or representations, whether express, implied, statutory or otherwise, relating in any way to the QSS Online Payment Facility are excluded.

8.2 Without limiting the generality of the above, we shall be under no liability to you in respect of any loss or damage (including consequential or economic loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of services supplied pursuant to these Terms and Conditions or in respect of a failure or omission on our part to comply with our obligations under these Terms and Conditions.

8.3 Where any legislation implies in these Terms and Conditions any term, condition or warranty, and that legislation avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in these Terms and Conditions. However, our liability for any breach of such term, condition or warranty shall be limited, to making the QSS Online Payment Facility available to you again.

8.4 You warrant that you have not relied on any representation made by us which has not been stated expressly in these Terms and Conditions or upon any descriptions or illustrations or specifications contained in any document including any catalogues or publicity material produced by us.

9. Amendments to Terms and Conditions

9.1 These Terms and Conditions may be updated or amended by us at any time. We will not provide notice of any such change.

10. Service Contracts

10.1 These Terms and Conditions do not in any way waive or reduce your obligations stipulated in any other agreement which you have entered into with Queen Street Studio.

11. Acceptance

11.1 The commencement of your use of the QSS Online Payment Facility constitutes acceptance of these Terms and Conditions. If you do not agree to these Terms and Conditions please do not use the QSS Online Payment Facility.
